By downloading, installing, or using Happy Planet Merge (“App”) and any related services (“Services”), you agree to these Terms of Use. If you do not agree, please do not use the App or Services.
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 or older. If we discover you are underage, we reserve the right to terminate your access.
We grant you a limited, non-exclusive, non-transferable license to use the App on your personal device. All intellectual property rights in the App and its content belong to us or our licensors. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.
Certain features may require purchase of virtual items or currency. All sales are final and non-refundable except as required by law. Virtual items have no cash value outside the App.
We may update, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We may also revise these Terms; continued use after changes indicates acceptance of the new Terms.
The App is provided “as is” and “as available,” without any warranties, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the App.
You agree to defend, indemnify, and hold harmless Happy Planet Merge and its affiliates from any claims, liabilities, damages, losses, or expenses arising from your breach of these Terms or your use of the App.
These Terms are governed by the laws of the jurisdiction where our company is headquartered, without regard to conflict of law principles. Disputes will be resolved in the courts of that jurisdiction.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
We may suspend or terminate your access to the App at any time, with or without reason or notice. Sections on ownership, warranty disclaimers, limitation of liability, and indemnity will survive termination.
